Commercial Real Estate Receivership Experience
Simon PLC has extensive experience serving as a court-appointed receiver over multifamily residential, mixed-use, and commercial real estate assets, including occupied and vacant properties, large-scale apartment portfolios, retail centers, and shopping malls. The Receiver has managed complex operations, overseen construction and redevelopment projects, coordinated with institutional lenders and servicers, preserved asset value, and facilitated sales and dispositions under court supervision.

Wayne County Circuit Court – Appointed November 17, 2025
Appointed receiver to manage a 45-unit occupied multifamily residential complex. Responsibilities included tenant management, rent collection, property maintenance, financial controls, and preservation of asset value.
Loan Funder LLC v. Kingdom Building 5 LLC
Wayne County Circuit Court – Appointed November 13, 2025
Appointed receiver to oversee a vacant multifamily building. Duties included securing the property, maintaining and preserving the asset, coordinating inspections and repairs, and reporting to the court.
Reginald Caldwell Jr. v. Shavon Caldwell
Wayne County Circuit Court – Appointed October 24, 2025
Appointed receiver to manage and sell real properties arising from a family dispute involving inheritance and control. Responsibilities included asset management, preservation of value, coordination with interested parties, and execution of court-ordered sales.
Situs Holdings LLC v. CCA CBD Detroit, LLC
Wayne County Circuit Court – Appointed June 30, 2025
Appointed receiver to manage and oversee an approximately 300-unit multifamily building with a retail component as part of an urban redevelopment project. Worked closely with the loan servicer and conduit lender to manage operations, preserve asset value, and comply with court directives.
John Secco, et al. v. Maximiliano Palacio, Corevest American Finance Lender, LLC, et al.
Wayne County Circuit Court – Appointed March 28, 2024
Appointed receiver to manage and oversee construction, renovation, and sale of a large multifamily portfolio consisting of more than 500 apartment units across 14 buildings. Responsibilities included oversight of construction activities, coordination with contractors and lenders, budget controls, and disposition of assets pursuant to court order.
Wells Fargo Bank v. William Gardella
Wayne County Circuit Court – Appointed June 12, 2019
Served as receiver over a retail strip center. Oversaw tenant relations, lease administration, maintenance, financial operations, and asset preservation.
Northland Center Michigan, LLC
Oakland County Circuit Court – Appointed September 29, 2014
Appointed receiver over a large regional shopping mall. Responsibilities included operational oversight, security, tenant coordination, and asset management during receivership.
Village Plaza Holdings, LLC
Oakland County Circuit Court – Appointed August 2012
Appointed receiver to manage a commercial building. Duties included property management, financial controls, and preservation of asset value.

Served as receiver over a shopping plaza with residential apartment components. Responsibilities included management of mixed-use operations, tenant oversight, and asset preservation pursuant to court order.
