Hospitality Receivership Experience
Simon PLC has extensive experience serving as a court-appointed receiver over hospitality, lodging, and event-venue properties, including hotels, resorts, banquet facilities, restaurants, and golf courses. The Receiver has managed ongoing operations, preserved going-concern value, maintained regulatory and licensing compliance, and facilitated sales and asset dispositions under court supervision.
Tittabawassee Resort, LLC, et al. v. Robert Edwards, et al.
Gladwin County Circuit Court – Appointed April 23, 2024
Appointed receiver to manage and operate a popular resort featuring a banquet center, wedding venue, and restaurant with an active liquor license during a shareholder dispute. Responsibilities included operational oversight, staffing and vendor management, preservation of goodwill and going-concern value, regulatory and liquor license compliance, and reporting to the court.
Wilmington Trust, National Association (CW Capital) v. Coldfoot, LLC
Wayne County Circuit Court – Appointed August 10, 2021
Appointed receiver to manage a fully occupied, operating Hampton Inn hotel. Duties included oversight of hotel operations, maintenance of brand and franchise standards, financial controls, asset preservation, and coordination with lenders and franchisor requirements.
CYFH, LLC
Oakland County Circuit Court – Appointed May 9, 2012
Appointed receiver to manage and sell a branded (flagged) hotel. Responsibilities included operational management, compliance with franchise obligations, marketing of the property, and execution of the court-approved sale.
JPMorgan Chase Bank v. Mourtous Enterprises
Wayne County Circuit Court – Appointed January 6, 2011
Served as court-appointed receiver over a banquet hall and golf course facility. Oversaw ongoing operations, asset preservation, coordination with vendors and staff, and disposition of assets pursuant to court order.
